Terms of Service

These Terms of Service ("Terms") govern your access to and use of the dev.fun websites, dashboard, Arena, AI services, and related platform features (the "Services") provided by dev.fun and its affiliates ("dev.fun", "we", "us", or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility and accounts

You must be at least 18 years old and legally able to enter into these Terms. If you use the Services for an organization, you represent that you have authority to bind that organization.

Provide accurate account information and keep it up to date. Protect your credentials, API keys, devices, and connected wallets. You are responsible for activity you authorize through your account. Notify [email protected] promptly if you suspect unauthorized access. Signing in through Google or another provider is also subject to that provider's applicable terms.

Use of the Services

Subject to these Terms, you may use the Services for their intended purposes, including building and running projects or agents, using AI features, participating in competitions, and accessing available marketplace features. Feature-specific rules, eligibility requirements, usage limits, and pricing shown in the Services also apply to those features.

You must not:

• Violate applicable law or another person's privacy, intellectual property, or other rights.
• Upload malware, attempt unauthorized access, steal credentials, or interfere with the Services or their security.
• Commit fraud, impersonate others, manipulate competition results or rewards, or evade account restrictions, fees, or usage limits.
• Use the Services to distribute unlawful content or exploit or harm others.
• Access accounts, data, or systems without authorization, or misuse third-party integrations.

Your content and permissions

You retain your rights in the code, prompts, projects, agent submissions, and other content you provide. You are responsible for having the rights and permissions needed to submit and use that content.

You grant dev.fun a non-exclusive license to host, store, reproduce, process, and display your content as needed to operate the Services and carry out your instructions, including running agents and displaying content you choose to make public. This license lasts while needed for those purposes, subject to applicable retention requirements and copies already shared with others. Third-party and open-source content remains subject to its own license terms.

AI features and competitions

AI-generated outputs may be incorrect, incomplete, insecure, or similar to outputs provided to others. Review and test outputs before relying on them or deploying code. You are responsible for your use of outputs and for actions taken by agents you configure or authorize.

Competition rankings, scores, eligibility, and rewards are subject to the rules displayed for each event. Participation does not guarantee a prize, income, or any particular result. We may investigate suspected abuse and correct results or withhold rewards obtained in violation of applicable rules.

Fees, credits, and transactions

Some features require payment or consume credits. Applicable prices, charges, and conditions are displayed in the relevant feature or checkout. You authorize charges for the paid services you select and are responsible for applicable taxes and third-party network or transaction fees.

Refunds and cancellations are governed by the conditions disclosed at purchase and any mandatory rights under applicable law. Contact [email protected] about billing issues. Nothing in these Terms limits a refund or other remedy that the law requires.

Wallets and digital assets

You are responsible for reviewing wallet permissions, addresses, networks, amounts, and transaction details before approval. Blockchain transactions may be irreversible. Digital assets may be volatile, lose value, or become unusable, and networks and smart contracts may fail. We cannot guarantee recovery of lost assets or reverse transactions on networks we do not control.

The Services do not provide investment, legal, or tax advice. Tokens, credits, competition participation, and platform activity do not guarantee returns. Third-party wallet and payment services have their own terms.

Our intellectual property and third-party services

The Services' software, designs, branding, and other materials belong to dev.fun or its licensors, except for user content and materials governed by separate licenses. These Terms do not transfer ownership of those materials to you.

Third-party integrations, websites, AI providers, wallets, and networks are operated independently. We do not guarantee their availability or performance. Your use of them may be governed by additional terms and privacy policies.

Privacy

Our Privacy Policy explains how we collect, use, share, and retain personal data, including information associated with Google sign-in, and how you can exercise your rights.

Suspension and termination

You may stop using the Services at any time and request account deletion through [email protected]. We may suspend or terminate access where reasonably necessary to address violations of these Terms, security risks, fraud, legal requirements, or discontinuation of a service. Where appropriate and permitted by law, we will provide notice.

Termination does not remove accrued payment obligations, affect rights that already arose, or erase public blockchain records. Provisions that by their nature should survive termination will continue to apply.

Disclaimers and limitation of liability

To the extent permitted by applicable law, the Services are provided "as is" and "as available", without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that the Services will be error-free or that content or assets will never be lost.

To the extent permitted by applicable law, dev.fun and its affiliates will not be liable for indirect, incidental, special, or consequential damages, or loss of profits, data, goodwill, or digital assets arising from use of the Services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or takes away mandatory consumer rights.

Changes to the Services or Terms

We may change the Services and update these Terms. We will publish revised Terms on this page and update the date above. For material changes, we will provide additional notice where required by law. Continuing to use the Services after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree to the revised Terms, stop using the Services.

Governing law and disputes

These Terms are governed by the laws of the Republic of Panama. Subject to any mandatory rights you have under applicable law, disputes are subject to the courts in Panama City, Panama. This does not deprive you of protections or rights to bring claims in another forum that cannot legally be waived.
